NEC Engineering and Construction Contract

The changes to the payment and adjudication procedures will be familiar to users of the NEC3 as they were set out in the NEC's September amendment supplement. The amendments in relation to compensation events in the Engineering and Construction Contract ECC do not significantly alter the position set out in the June edition.

The use of a project bank account is introduced through new Option Y UK 1. Similar to the Construction Act amendments, this is addressed through incorporating and amending a previously published NEC supplement in relation to project bank accounts.

Option Y UK 1 sets out the requirements for the contractor to establish the account, for the named suppliers sub-contractors that will benefit from payments from the project bank account to sign the trust deed and the time for and effect of payment from the project bank account. In addition to the above key changes, the April suite now also includes a new professional services short contract and seven guidance documents on use of the NEC3 suite, including guides on completion of technical documents for use with the contracts and using the contracts in a building information modelling BIM environment.
