After the end of World War II a series of conventions and declarations began to articulate universal human rights.

The work of formalizing the Universal Declaration of Human Rights into a legally binding international treaty eventually resulted in two separate treaties. The ICCPR is one of the two, and embodies fundamental human rights as traditionally understood, such as self-determination, freedom from discrimination, freedom of movement, and prohibitions on torture or inhuman treatment. International Covenant on Civil and Political Rights 1966

This essay deals with social, economic and cultural rights and political and civil rights within the context of international law on human rights. To this end, it reviews the contemporary conception of this issue in the light of the international system of protection, evaluating its profile, its objectives, its logic and its principles, and questioning the feasibility of an integrated vision of human rights. This is followed by an evaluation of the main challenges and prospects for the implementation of these rights, claiming that facing this challenge is essential to ensure that human rights will take on their central role in the contemporary order. How to understand the contemporary formulation of human rights. Human rights come into being as and when they are able and required to do so. As Norberto Bobbio emphasizes, human rights do not arise either all at once or for good. To Hannah Arendt, human rights are not given facts, but a construct, a human invention that is subject to an ongoing process of construction and reconstruction.

Each State Party to the present Covenant undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the present Covenant, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. In time of public emergency which threatens the life of the nation and the existence of which is officially proclaimed, the States Parties to the present Covenant may take measures derogating from their obligations under the present Covenant to the extent strictly required by the exigencies of the situation, provided that such measures are not inconsistent with their other obligations under international law and do not involve discrimination solely on the ground of race, colour, sex, language, religion or social origin. No derogation from articles 6, 7, 8 paragraphs I and 2 , 11, 15, 16 and 18 may be made under this provision. Everyone shall have the right to freedom of thought, conscience and religion. This right shall include freedom to have or to adopt a religion or belief of his choice, and freedom, either individually or in community with others and in public or private, to manifest his religion or belief in worship, observance, practice and teaching. No one shall be subject to coercion which would impair his freedom to have or to adopt a religion or belief of his choice. The States Parties to the present Covenant undertake to have respect for the liberty of parents and, when applicable, legal guardians to ensure the religious and moral education of their children in conformity with their own convictions.

Article 49 allowed that the covenant would enter into force three months after the date of the deposit of the thirty-fifth instrument of ratification or accession. The covenant commits its parties to respect the civil and political rights of individuals, including the right to life , freedom of religion , freedom of speech , freedom of assembly , electoral rights and rights to due process and a fair trial. States must report initially one year after acceding to the Covenant and then whenever the Committee requests usually every four years. The Committee normally meets in Geneva and normally holds three sessions per year. The States Parties to the present Covenant, including those having responsibility for the administration of Non-Self-Governing and Trust Territories , shall promote the realization of the right of self-determination , and shall respect that right, in conformity with the provisions of the Charter of the United Nations. Drafting continued on the convention, but there remained significant differences between UN members on the relative importance of negative Civil and Political versus positive Economic, Social and Cultural Rights.

Both covenants have been widely ratified by the vast majority of African States. However, a largely neglected area of study has been assessing the influence of the ICESCR in various parts of the world including Africa.
